Throughout these Terms, “we”, “us” and “our” refer to Deoxygro Ltd trading as SkinCosmic®.
2. These Terms
These Terms & Conditions govern your use of this website and any purchase of products from SkinCosmic®.
By accessing this website, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use this website.
We may revise these Terms from time to time to reflect changes in law, regulation, business operations, products, or website functionality. The version published on this website at the time of your use or purchase will apply.
3. Product Positioning and Information
SkinCosmic® products are offered as cosmetic products. They are intended to support the appearance and condition of the skin, scalp, hair, lashes, and brows. They are not medicines and are not intended to diagnose, treat, cure, or prevent disease. UK guidance treats product claims and presentation as highly relevant to whether something may be classed as a medicine rather than a cosmetic product.
All content on this website is provided for general information only. It is not medical advice and should not be relied upon as a substitute for advice from a doctor, pharmacist, or other appropriately qualified healthcare professional.
If you have an underlying medical condition, a diagnosed skin, scalp, lash, brow, or hair disorder, are pregnant or breastfeeding, are taking medication, are undergoing treatment, or have specific concerns about suitability, you should consult a qualified healthcare professional before use.
We make reasonable efforts to ensure that product descriptions, imagery, ingredient information, directions, and other content are accurate. However, minor differences in packaging, labelling, colour, or presentation may occur.
4. Eligibility to Purchase
By placing an order, you confirm that you are legally capable of entering into a binding contract and that all information you provide is accurate and complete.
We reserve the right to refuse service, suspend accounts, cancel orders, or restrict sales where we reasonably believe there has been misuse of the website, fraud, abuse of promotions, unauthorised resale activity, or breach of these Terms.
5. Orders and Contract Formation
All orders are subject to acceptance and availability.
When you place an order, you are making an offer to purchase the selected product(s). A binding contract is formed only when we accept the order and dispatch the goods. Order confirmation emails acknowledging receipt do not by themselves amount to acceptance.
We reserve the right to refuse or cancel any order, including where:
pricing or product information contains an obvious error;
the product is unavailable;
we suspect fraudulent, abusive, or unauthorised activity;
the order appears intended for unauthorised commercial resale;
we are unable to verify payment or delivery information.
If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method.
6. Pricing and Payment
All prices shown on the website are in GBP (£) and include VAT where applicable unless otherwise stated.
We may change prices at any time, but changes will not affect orders that have already been accepted.
Payment must be made in full at checkout or otherwise before dispatch. We reserve the right to decline or delay dispatch until payment has been successfully authorised and received.
You are responsible for ensuring that billing details, shipping details, and any other information submitted with your order are accurate.
7. Product Availability
All products are offered subject to stock availability. We may withdraw, amend, suspend, or discontinue any product at any time without prior notice.
Where a product becomes unavailable after an order is placed but before dispatch, we may cancel that part of the order and issue a refund for the unavailable item.
8. Delivery
Delivery times are estimates only and are not guaranteed. Guidance for distance selling makes clear that consumers must be informed about cancellation rights and related delivery information when selling online.
We are not liable for delays caused by third-party delivery providers, customs processes, adverse weather, industrial action, supply chain disruption, or events outside our reasonable control.
Risk in the products passes to you on delivery to the address provided in your order.
You are responsible for providing a complete and accurate delivery address. We are not responsible for failed delivery, delay, loss, or redirection costs arising from inaccurate or incomplete address information supplied by you.
If a parcel is returned to us because delivery could not be completed due to incorrect address information, refusal of delivery, or failure to collect, we may charge you the reasonable cost of redelivery.
9. Consumer Cancellation Rights
If you are purchasing as a consumer, you may have a legal right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. For most goods bought online, the cancellation period ends 14 days after the day you receive the goods. Official guidance also states that consumers should return goods within 14 days of cancellation.
To exercise your cancellation right, you must clearly inform us of your decision to cancel before the cancellation period expires.
You must then send the goods back to us without undue delay and, in any event, no later than 14 days after telling us you wish to cancel. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.
Your right to cancel does not affect your separate legal rights if goods are faulty, not as described, or otherwise not in conformity with contract.
10. Returns and Refunds
We accept eligible returns in accordance with your statutory rights and this policy.
To be eligible for a return where you have changed your mind:
the item must be unused;
the item must be in its original condition;
any sealed product must remain unopened with any hygiene or tamper seal intact.
Because these are cosmetic products, opened items may not be suitable for resale or return for hygiene reasons unless they are faulty, damaged, or not as described.
Unless the item is faulty, damaged, or sent in error, the cost of return shipping is the responsibility of the customer.
We strongly recommend using a tracked and insured service for returns. We are not responsible for returned parcels lost or damaged in transit before they are received by us.
Approved refunds will be made to the original payment method within 14 days of the applicable trigger under the Regulations, usually receipt of the returned goods or evidence of return. Original standard delivery charges are refundable only where required by law.
We reserve the right to reduce a refund to reflect any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. Official guidance under the Consumer Contracts Regulations allows traders to reduce the amount refunded for diminished value in appropriate cases.
11. Faulty, Damaged, Incorrect, or Non-Conforming Goods
Nothing in these Terms limits or excludes your statutory rights under the Consumer Rights Act 2015. Under that Act, goods must be as described, of satisfactory quality, and fit for purpose, and statutory remedies may include repair, replacement, or refund depending on the circumstances.
If you believe an item is faulty, damaged, incorrect, or not as described, please contact us as soon as reasonably possible at info@skincosmic.com with your order details and a description of the issue. We may ask for photographs or other information to assess the problem before confirming the appropriate remedy.
Where a return is required because the goods are faulty, damaged, incorrect, or otherwise not in conformity with contract, we will handle the matter in accordance with your statutory rights.
12. Product Use, Safety, and Patch Testing
Products must be used only as directed and for their intended cosmetic purpose.
You are responsible for reading the label, ingredient list, warnings, usage instructions, and storage guidance before use.
As with all cosmetic products, individual reactions may occur. We recommend carrying out a patch test prior to first use, particularly if you have sensitive skin, a history of allergy, or any underlying condition affecting the skin or scalp.
Discontinue use if irritation or adverse reaction occurs and seek medical advice where appropriate.
SkinCosmic® is not responsible for adverse effects arising from misuse, failure to follow instructions, failure to patch test where appropriate, use contrary to warnings, or use in circumstances where professional advice should reasonably have been sought beforehand.
13. Results Disclaimer
Results vary between individuals and depend on many factors, including biology, consistency of use, environment, hair or skin condition, lifestyle, and other individual variables.
Any statements on this website relating to ingredients, formulation design, or cosmetic performance are provided in the context of general cosmetic use and product positioning. They do not amount to a guarantee of any particular result, timeframe, or level of benefit.
14. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to the paragraph above, and to the fullest extent permitted by law:
our total liability to you in connection with any order, product, or use of this website shall not exceed the amount paid by you for the relevant product(s);
we shall not be liable for any indirect, incidental, special, or consequential loss;
we shall not be liable for loss of profit, loss of business, loss of opportunity, loss of goodwill, or reputational damage.
This clause does not affect rights that cannot lawfully be excluded for consumers.
15. Intellectual Property
All intellectual property rights in this website and its content, including text, copy, product names, branding, logos, graphics, design, layout, photographs, imagery, downloads, and compilation, are owned by or licensed to Deoxygro Ltd unless otherwise stated.
You may not reproduce, copy, republish, modify, distribute, adapt, display, transmit, or commercially exploit any part of the website or its content without our prior written consent.
No right, title, or interest in any intellectual property is transferred to you by your use of the website or purchase of products.
16. User Conduct and Website Use
You agree not to use this website:
for any unlawful purpose;
to engage in fraud or misrepresentation;
to interfere with the security or operation of the website;
to attempt unauthorised access to systems or data;
to introduce viruses, malware, or harmful code;
to scrape, reproduce, or harvest content without authorisation;
to use the website in a way that could damage the brand or reputation of SkinCosmic®.
We reserve the right to suspend or terminate access where we reasonably believe there has been misuse.
17. Promotions, Gift Cards, Discount Codes, and Offers
From time to time we may offer promotions, discounts, introductory offers, gifts with purchase, or other incentives.
Unless expressly stated otherwise:
discount codes cannot be combined;
discount codes have no cash value;
discount codes are non-transferable;
promotions may be amended, suspended, or withdrawn at any time;
we may cancel or refuse any discount or promotional benefit where misuse, duplication, technical error, or abuse is suspected.
Where a return is made for an order purchased using a promotional discount, the refund will reflect the price actually paid.
18. Third-Party Links and Platforms
This website may contain links to third-party websites or services. These are provided for convenience only. We are not responsible for their content, terms, privacy practices, or availability.
If you purchase SkinCosmic® products through a third-party marketplace or platform, such as Amazon, additional platform rules or terms may apply to your purchase and may govern certain aspects of fulfilment, returns, or dispute handling.
19. Wholesale, Retail, and Distribution
Where products are supplied for resale, distribution, or other business purposes:
the buyer is responsible for ensuring compliance with all applicable laws, regulations, import requirements, labelling obligations, and market-specific requirements in the territories in which the products are sold;
products must not be altered, repackaged, relabelled, or presented in a misleading way without our prior written consent;
marketing claims must remain consistent with the approved cosmetic positioning of the products;
no reseller may present the products as medicines, medical devices, or as having unauthorised therapeutic effects.
We disclaim liability for downstream non-compliance, misrepresentation, improper storage, mishandling, unauthorised claim expansion, or marketplace breaches by retailers, distributors, or other third parties after delivery.
We reserve the right to suspend or terminate supply to any wholesale or retail partner who breaches these requirements.
20. Regulatory Position
SkinCosmic® products are intended to be marketed as cosmetic products in line with applicable UK cosmetic law and guidance. Government guidance for Great Britain explains that cosmetic products made available to the public are subject to Regulation (EC) No 1223/2009 as amended for GB, and that claims and presentation matter when distinguishing cosmetics from medicines.
Where products are supplied outside the UK, the customer, distributor, retailer, or importer is responsible for ensuring compliance with local laws, regulatory requirements, and permitted claims in the relevant jurisdiction.
Any references to manufacturing standards, testing, or formulation philosophy are provided for transparency and brand positioning and should not be taken as a representation that the product is a medicinal product.
21. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Deoxygro Ltd, SkinCosmic®, and our officers, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses arising out of or connected with:
your breach of these Terms;
your misuse of the website;
your misuse of products;
your infringement of intellectual property rights;
your unlawful resale, relabelling, or redistribution of products;
your expansion or alteration of product claims in downstream marketing or sales materials.
This clause is intended primarily for business users, resellers, distributors, and persons acting beyond ordinary private consumer use.
22. Force Majeure
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including supply interruption, courier failure, customs delay, natural disaster, severe weather, epidemic or pandemic disruption, fire, flood, cyber incident, industrial dispute, regulatory change, power or telecoms outage, or other force majeure event.
Where such events occur, our obligations will be suspended for the duration of the event, and we will take reasonable steps to minimise disruption where practicable.
23. Privacy and Data Protection
We process personal data in accordance with applicable UK data protection law, including the UK GDPR and the Data Protection Act 2018. ICO guidance makes clear that individuals must be told in a clear and concise way what personal data is collected, why it is used, the lawful basis relied upon, and what rights they have.
Please read our Privacy Policy for full details of how we collect, use, store, and protect personal data.
24. Severability
If any part of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.
25. Waiver
If we delay or fail to exercise any right or remedy available to us, this does not mean that we waive that right or remedy.
26. Entire Agreement
These Terms, together with any policies expressly referred to in them, set out the entire agreement between you and us in relation to your use of this website and your purchase of products from it, except for any additional written agreement entered into with authorised wholesale or distribution partners.
27. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation shall be governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer law provides otherwise.
